ATTORNEY EXAMINES SEXUAL HARASSMENT ALLEGATIONS,
MEDIA AND THE LAW DURING BERKELEY COLLEGE
MBA EXECUTIVE SPEAKER SERIES

Berkeley College Joseph L. Haines, Esq., a Pennsylvania attorney with 27 years of experience, shared how sexual harassment allegations intersect with media and the law, during the latest engagement of the Berkeley College MBA Executive Speaker Series, held on January 23, 2018, at the Berkeley College School of Graduate Studies in Woodland Park, NJ.

Mr. Haines, whose areas of expertise include civil litigation, consumer and commercial debt collection and bankruptcy law, discussed the Sixth Amendment to the U.S. Constitution, which gives rights to the accused, and how recent allegations have played out in the media instead of in a courtroom.  

“It’s a hard subject to confront because it’s ugly,” he said. “There should be no harassment. But when it happens now, would you agree there seems to be a rush to judgment?”

 

Mr. Haines analyzed the allegations against Senator Al Franken, television personality Matt Lauer, and others who were tried in a court of public opinion. He also acknowledged a watershed moment in the history of sexual harassment, with victims feeling more comfortable in speaking out through the #MeToo movement.

“We’ve seen recent accusations made that are decades old. We’ve seen accusations that end careers just on the basis of the accusation alone,” Mr. Haines said. “We have to find a way to funnel these claims through the court system. We want to protect the rights of a woman or man to make the allegation freely. By the same token, we want to protect the right of the accused.”

Mr. Haines is licensed to practice in Pennsylvania, the U.S. District Court for the Eastern District of Pennsylvania, and the U.S. Tax Court. During his career, he has served as legal counsel to several publicly traded financial institutions, providing guidance on collection of delinquent and defaulted debt, as well as regulatory and general governmental compliance matters.

Previous speakers in the MBA Executive Speaker Series have included representatives from Ernst & Young, ADP and Brightpoint Health.

“The Executive Speaker Series takes the theories and ideas presented in the classroom and links them to real-world practices,” said Mary Wagner, PhD, Interim Dean, Berkeley College School of Graduate Studies. “These conversations with industry professionals allow students to approach a topic from many perspectives and prepare them to be effective managers.”

Monika Konior, a Berkeley College student in the MBA in Management program, said the event gave her a broader understanding of topics in the legal field.

“The discussion opened my mind to not only consider the victim, but also to consider the effects of the allegations on the accused,” she said. “It is important to consider both sides and do further research than to depend entirely on statements made by the media.”
